Para-Storm Fest Terms of Service
Last Updated: August 31, 2026
These Terms of Service (“Terms”) govern your access to and use of the website located at https://para-stormfest.net/ and related services (collectively, the “Site”).
By clicking “I Agree,” creating an account, submitting an application, purchasing a ticket through a linked platform, or otherwise using the Site, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to enter into these Terms. If you are a minor, you may use the Site only with the permission and supervision of a parent or legal guardian, who is responsible for your use of the Site and acceptance of these Terms.
2. Use of the Site
You may use the Site only for lawful purposes. You may not:
- violate any applicable law or third-party right;
- interfere with the Site or its security;
- attempt unauthorized access;
- transmit malware or harmful code;
- scrape, copy, or reproduce Site content without permission;
- impersonate another person or misrepresent your affiliation;
- submit false, misleading, or incomplete information; or
- use the Site for fraud, harassment, abuse, or unlawful commercial purposes.
We may suspend or terminate access to the Site for violations of these Terms.
3. Tickets and Event Information
2027 ticket sales and prices are not currently published. Before sales open, the Site will identify the approved checkout, the mandatory-fee-inclusive total price, and the applicable cancellation and refund terms.
Tickets may be sold through a third-party ticketing provider. Before paying, review the current price, fees, admission information, refund or cancellation policy, transfer rules, and every other condition displayed by the live checkout.
The dates, public hours, and venue shown on this Site are the currently verified 2027 event information. Performers, vendors, schedules, attractions, prices, admission requirements, and other details remain subject to later official publication or change.
This Site does not currently publish a 2027 refund, cancellation, postponement, transfer, or entry rule. Do not rely on a prior-year policy. The terms presented by the approved live checkout at the time of a purchase are the terms a purchaser must review.
4. Event Rules and Removal
Final 2027 on-site and admission rules are not currently published. Before attending, review the current event and venue information released through this Site or the organizer’s verified channels.
Use of the Site does not replace a visitor’s responsibility to follow applicable law and any current, lawfully posted safety or venue instructions. Nothing in these Terms authorizes discrimination prohibited by law or creates an unpublished ticket condition.
5. Vendors and Applications
Submitting an application, registration, inquiry, or request does not guarantee acceptance, sponsorship, placement, participation, or admission.
You represent that information submitted to Para-Storm Fest is accurate, current, and complete. Vendors and other participants may be required to sign separate written agreements. If a separate agreement conflicts with these Terms, the separate agreement controls for that subject.
Outdoor vendor spaces are 10 feet by 10 feet and cost $50. Outdoor vendors must provide their own table, chair, and canopy. Indoor vendor spaces cost $75 and include one table and two chairs. All spaces remain subject to availability and written acceptance.
Do not send payment with an application. Approved vendors will receive written acceptance identifying their booth type, fee, payment instructions, and any applicable setup, safety, permit, licensing, insurance, access, or selling requirements.
Vendor fees are nonrefundable unless Para-Storm Fest cancels the event. This policy remains subject to rights and remedies that cannot lawfully be waived.
6. User Submissions
If you submit text, photographs, artwork, reviews, applications, comments, or other material (“User Content”), you represent that:
- you own or have permission to submit it;
- it does not violate another person’s rights;
- it is not unlawful, defamatory, fraudulent, or harmful; and
- its submission does not breach another agreement.
You grant Para-Storm Fest a limited, nonexclusive license to store, format, and use a submission only as needed to review it, respond, administer the requested relationship, secure the Site, and meet legal recordkeeping needs. Promotional publication of a participant’s content, name, likeness, or logo requires a separate appropriate permission. You retain ownership of your User Content.
We may remove User Content that we reasonably believe violates these Terms or applicable law.
7. Intellectual Property
The Site contains festival-created material and material associated with participants, vendors, venues, and other third parties. Ownership and permitted use depend on the specific asset. No ownership, license, sponsorship, beneficiary relationship, or endorsement should be inferred from appearance alone; material may be withheld or removed while rights are verified.
Except as permitted by law or expressly authorized in writing, you may not copy, modify, distribute, publicly display, sell, license, scrape, reverse engineer, or create derivative works from Site content. These Terms do not grant you ownership of or a license to any copyright, trademark, logo, trade dress, or other intellectual-property right.
Third-party names, logos, and marks remain the property of their respective owners. Their appearance on the Site does not necessarily imply sponsorship, endorsement, affiliation, or ownership by Para-Storm Fest.
8. Third-Party Services and Links
The Site may link to ticketing platforms, merchandise sellers, payment processors, social-media pages, sponsors, vendors, and other third-party services. Para-Storm Fest does not control or guarantee those services and is not responsible for their content, availability, security, policies, products, transactions, or conduct.
Your use of a third-party service is governed by that provider’s terms and policies.
9. Merchandise and External Purchases
Merchandise or other products promoted through the Site may be sold by third parties. Pricing, fulfillment, shipping, taxes, returns, exchanges, refunds, warranties, and customer service are controlled by the applicable seller or platform.
10. Privacy
Your use of the Site is also governed by the Para-Storm Fest Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PARA-STORM FEST DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
We do not guarantee that the Site will be uninterrupted, error-free, secure, current, complete, or free of harmful code.
These disclaimers do not limit rights or remedies that cannot lawfully be waived.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARA-STORM FEST AND ITS OWNERS, ORGANIZERS, AFFILIATES, VOLUNTEERS, SPONSORS, VENDORS, CONTRACTORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE SITE, EVENT INFORMATION, THIRD-PARTY SERVICES, TICKETS, MERCHANDISE, EVENT CHANGES, CANCELLATIONS, DELAYS, OR YOUR USE OF THE SITE.
To the maximum extent permitted by applicable law, the event hosts, Para-Storm Fest organizers and volunteers, and East Huntingdon Township Volunteer Fire Company (“East Huntingdon VFC”) are not responsible for injury to vendors or attendees, or for loss of or damage to vendor or attendee property, arising from participation in or attendance at the event.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence where such limitation is prohibited by law.
13. Indemnification
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Para-Storm Fest and its owners, organizers, affiliates, volunteers, sponsors, vendors, contractors, service providers, and representatives from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from:
- your breach of these Terms;
- your misuse of the Site;
- your User Content;
- your violation of law or a third party’s rights; or
- your willful, reckless, or negligent conduct.
Para-Storm Fest will provide reasonably prompt notice of a covered claim and may participate in its defense. You may not settle a claim imposing liability or obligations on Para-Storm Fest without our written consent.
14. Changes to These Terms
We may revise these Terms by posting an updated version and changing the “Last Updated” date. For material changes, we will provide reasonable notice where practicable and may require renewed affirmative acceptance.
The revised Terms apply prospectively and do not alter rights or obligations that accrued before the effective date unless permitted by law.
15. Termination
We may suspend or terminate your access to the Site at any time for violation of these Terms, unlawful conduct, security concerns, or operational reasons. Sections concerning intellectual property, User Content, disclaimers, liability, indemnification, dispute resolution, and provisions that by their nature should survive will survive termination.
16. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.
Any court proceeding arising from or relating to these Terms or the Site must be brought in the state or federal courts located in Pennsylvania, and you consent to their personal jurisdiction and venue, except where applicable law requires another forum.
17. General Provisions
If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain effective.
A failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, sale, reorganization, or transfer of the Site or festival business.
These Terms, together with documents incorporated by reference, constitute the entire agreement concerning your use of the Site and supersede prior understandings on that subject.
18. Electronic Communications
You consent to receiving transactional notices about a request, application, registration, purchase, security event, or these Terms electronically, including by email or website posting. This is not consent to marketing email, automated calls, or text messages. Electronic records and electronic acceptance may be used to establish your agreement to these Terms.
